A class action lawsuit was filed in a federal court in Brooklyn NY related to the failure of the lamp(s) in 2004 and 2005 DLP Toshiba models (Ersler v. Toshiba America Inc.). While Toshiba and TACP disputed the allegations made in the lawsuit and disputed any alleged wrong doing, in order to avoid significant defense costs, TACP entered into a settlement.
The deadline for filing claims for refunds under the settlement reached passed on July 6, 2009. We are sorry; claims are no longer eligible for a refund.
Those consumers who filed proper claims within the eligibility requirements of the settlement should have received their payments by now. If you have not received a payment, it is because TACP determined that your claim either did not meet the eligibility requirements of the settlement, or was otherwise defective because the claim was not properly filed or did not include the necessary supporting information and documents. TACPs claims agent, The Garden City Group, Inc., should have advised those consumers who filed such defective claims of the problem by mail and provided them with 30 days to correct the problem. Those letters were sent several months ago, and the time to correct such defective claims has now passed.
As a result of the same class action settlement under which TACP made such refunds, TACP also agreed to extend the warranty on replacement bulbs for 2004 and 2005 model DLP TVs from 180 days to 12 months on replacement bulbs. The new 12-month warranty is in effect only for those replacement bulbs purchased after April 27, 2009.
